These Terms of Service (the "Terms") govern your access to and use of the carflash.ai website, applications, and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility & Account

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for maintaining the security of your account and for all activity that occurs under it.

2. Use of the Service

carflash.ai allows you to upload vehicle photos and generate enhanced or AI-edited images ("Output"). You agree to use the Service in compliance with all applicable laws, including any advertising, consumer protection, privacy, and vehicle disclosure laws or regulations.

You are solely responsible for reviewing and verifying all Output before using it in any context, including listings, marketing materials, or other communications.

3. User Content & Rights to Upload

You retain all rights to the photos and other content you upload to the Service ("Input"). By using the Service, you represent and warrant that:

• You have all necessary rights, licenses, and permissions to upload the Input and to use it with the Service.
• Your Input does not infringe or violate any third-party rights, including copyright, trademark, privacy, or publicity rights.

You grant carflash.ai a worldwide, non-exclusive, royalty-free license to host, process, and use your Input and Output solely for the purpose of providing and improving the Service (including quality control, debugging, and analytics).

4. Generated Images & Vehicle Misrepresentation

The Service uses automated and AI-based processing that may alter or enhance your original images. While the goal is to create studio-quality representations, the Output may not always be an accurate or complete depiction of the actual vehicle condition, features, or configuration.

You understand and agree that you are solely responsible for:

• Ensuring that any Output you use in listings or marketing materials does not materially misrepresent the vehicle.
• Complying with all disclosure and advertising requirements applicable in your jurisdiction.

carflash.ai is not responsible or liable for any claim, dispute, loss, or damage arising from your use of Output that misrepresents a vehicle or otherwise violates law, policy, or third-party rights.

5. Credits, Fees & Payments

The Service may be provided on a credit basis, where a credit represents the right to process a certain number of images. Pricing and credit packages are described within the Service and may change from time to time.

Payments are processed by third-party processors (such as Stripe), and their terms may apply in addition to these Terms. carflash.ai does not store full payment card numbers.

Except where required by law, all purchases are final and non-refundable. Credits may be subject to expiration or usage conditions as communicated in the Service.

6. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe or violate the rights of others, including intellectual property and privacy rights.
• Upload harmful, illegal, or abusive content, or attempt to interfere with the proper operation of the Service.

7. Disclaimers

The Service and all Output are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory.

Without limiting the foregoing, carflash.ai does not warrant that:

• The Output will be accurate, complete, or error-free.
• The Service will meet your specific business goals or performance targets.
• The Service will be uninterrupted, secure, or free from defects.

8. Limitation of Liability

To the maximum extent permitted by law, carflash.ai and its owners, affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service or Output.

To the maximum extent permitted by law, the total liability of carflash.ai for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid to carflash.ai for the Service in the 3 months prior to the event giving rise to the claim, or (b) USD $100.

9. Indemnification

You agree to indemnify, defend, and hold harmless carflash.ai and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Service or Output.
• Your violation of these Terms or any applicable law or regulation.
• Any misrepresentation of vehicles or other materials using Output.
• Any claim that your Input or use of the Output infringes or violates a third party’s rights.

10. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or are using the Service in a way that could cause harm. You may stop using the Service at any time.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice by updating the "Last updated" date or by other reasonable means. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
